These are the rules that we use to operate Formby Festival in order to to ensure the best possible experience for our guests.
ANYONE AGED UNDER 16 MUST BE ACCOMPANIED BY A FEE PAYING ADULT AGED 18+.
1. Definitions and interpretation
In these Terms & Conditions:
1.1 Event refers to any of the activities taking place at Duke Street Park as part of Formby Festival.
1.2 The Promoter, we, us and our refers to Formby Festival CIC Ltd and any associated representative or sub-contractor.
1.3 You and your refers to you as the patron/visitor/guest, or anybody who, in our reasonable opinion, acts with your authority or permission.
1.4 These terms and conditions incorporate, and should be read together with, associated vendor’s or agent’s terms or regulations.
1.5 Being in the secured area of Duke Street Park from 12th July at 9am until 17th July at 6pm constitutes your acceptance of these terms and conditions.
1.6 Buying a ticket or wristband constitutes your acceptance of these terms and conditions.
2. General
2.1 By attending the Event, you give your express consent to be photographed and videoed for security reasons.
2.2 By attending the Event, you agree that you may be included in photos or videos that are taken to visually document the event or to promote future events run by us. Copyright will be owned by us without payment or compensation.
2.3 Unauthorised professional video or sound recording is not allowed. We may confiscate and/or destroy unauthorised recordings.
2.4 We may change the published bill and/or running times without notification. This includes, but is not limited to, artists and billed attractions. Entry is for the Event and not a specific artist. Every effort is made to ensure that the full, advertised billed performances and activities take place.
2.5 Trading is not allowed on site without our consent.
2.6 This is an outdoor festival including music and special effects. You should expect loud music in some areas, effects such as pyrotechnics, lasers, smoke machines, flashing lights, crowded areas and darkness during the firework display.
2.7 We do not accept any responsibility for the availability, reliability, or speed of any festival wi-fi network.
2.8 Complaints in relation to the festival before the event should be made by email to info@formbyfestival.co.uk .
2.9 Complaints during the event should be made immediately to the Duty Manager via a steward.
3. Admission
3.1 We reserve the right to refuse admission.
3.2 We reserve the right to remove a person from the site, without refund, if we identify a threat to public safety, or unacceptable behaviour likely to cause damage, nuisance, or for a breach of these terms and conditions. You agree comply with any and all instructions given to you by Event staff and stewards.
3.3 Search is a condition of entry to the Event. You agree to being searched during the festival.
3.4 Alcoholic drinks brought to the festival are confiscated on entry. There are outlets on site offering competitively-priced alcoholic and non-alcoholic drinks.
3.5 Food is not allowed to be brought on site and will be confiscated at the gate. The only exception is baby food, baby milk or if you have any special dietary requirements or food allergies and will be limited to a small plastic sandwich bag no bigger than 10” x 10” in size.
3.6 Cooler boxes are not allowed on site.
4. Safety and Security
4.1 We do not accept liability for personal damages, losses, or injuries sustained at the Event. Personal property brought to the Event is at your own risk.
4.2 You must follow safety announcements and directions from stewards.
4.3 You should not enter the site if you have Covid-19.
4.4 Possession or use of illegal substances is not allowed.
4.5 We reserve the right to confiscate any items deemed by us to be dangerous or inappropriate as well as our prohibited list, without being liable for any loss, theft or damage to confiscated items. Prohibited Items: air horns; professional recording equipment; animals other than dogs on leads; BBQs; chinese lanterns; firearms; fireworks; flares; gas canisters/cylinders; glass bottles; glass of any kind; hammers; illegal substances; legal highs; knives; laser pens/laser equipment; drones; smoke canisters; sound systems.
4.6 Your details may be used for the marketing of future events organised by Formby Festival. Data collected during the purchase of tickets will not be passed onto any third party. Please email info@formbyfestival.co.uk to have your details removed.
4.7 Smoking is not permitted inside marquees, including e-cigs/vaping.
4.8 You agree to comply with any measures put in place to combat the spread of Covid-19.
5. Tickets and Wristbands
5.1 A ticket or a QR code must be exchanged for a wristband on first entry to the site. Re-admission is with a wristband only. Wristbands are non-transferable and are invalid if removed or tampered with. Wristbands must be worn at all times for the duration of the Event.
5.2 The ticket holder is responsible for a ticket until it is exchanged for a wristband. A ticket should not be duplicated: only the first copy scanned will be admitted regardless of original ownership. Void tickets are not refundable.
5.3 If you use or attempt to use using a void ticket or wristband, you will be refused entry, removed from the site and you may be liable to legal action for trespass.
5.4 Formby Festival will not issue duplicates for lost or stolen tickets or wristbands.
5.5 Where a concession is claimed, proof of identity and concession entitlement (for example of age or student status) may be required.
5.6 Children under 16 (ie age 15 or under) must be accompanied by an adult ticket holder (aged 18 or over) every time that they enter the site. That adult must remain on-site as their guardian. Unaccompanied under-16s are not allowed on site. We do not accept parental or supervisory duty of care or liability for any under 18s on site.
5.7 Children under 4 (3 years old or less) are admitted free but must be accompanied by a paying ticket-holder adult.
5.8 Everyone must have a wristband, including children. Name tags for children up to the age of 12 will be available from the wristband exchange to write a mobile number in case of separation from their guardian.
6. Price and Payment
6.1 The price of the Ticket shall be the price set at the time we accept your order. All prices set are inclusive of any applicable taxes and booking fee but excluding any collection or delivery fee. No order will be accepted until we have received full payment.
7. Cancellation, Refunds and Exchanges
7.1 If the event is cancelled, a ticket refund must be applied for no later than 90 days after the original ticket date. The refund fee is subject to the terms and conditions of the point of sale. We shall not be liable for any costs other than the ticket refund. Refunds are only considered if the Event is cancelled in full and is not rescheduled.
7.2 Refunds will not be made due to your illness.
7.3 Refunds will not be made if we make changes that, in our opinion, could be reasonably expected for such an event. The following are not deemed to be ‘material alterations’: changes to the event line-up; adverse weather conditions; changes to individual artists, bands or performers; curtailment when the majority of the event has taken place; and delays to starting a performance or the event.
7.4 We shall not be liable for any losses incurred from personal arrangements, such as travel costs, or other expenditure beyond the ticket refund.
7.5 It is your responsibility to ascertain whether the event has been cancelled or re-scheduled. If we have to cancel or re-schedule the event, we will use reasonable endeavours to communicate with you through social media, our website and directly using the details that you provided at the time of ordering. We cannot guarantee that you will be directly informed of such cancellation.
7.6 It is your responsibility to inform us of any change to the contact address, telephone number or email address given to us at the time of ordering.
8. About Terms and Conditions
8.1 We will not be liable to you for failure to perform any obligation under these Terms and Conditions to the extent that the failure is caused by Force Majeure, such as act of God, war, insurrection, riot, civil disturbances, acts of terrorism, fire, explosion, flood, theft of essential equipment, malicious damage, strike, lock-out, weather, third party injunction, national defence requirements, acts or regulations of national or local governments, Covid 19, Pandemic.
8.2 These terms and conditions should be read and considered before entering into the contract, to ensure that they contain everything that you consider has been agreed. If they do not then you should contact info@formbyfestival.co.uk beforehand. After the contract has been made, these Terms and Conditions cannot be varied or amended in any respect unless both you and we agree in writing.
8.3 Nothing in these Terms and Conditions, and no action taken by you or us under these Terms and Conditions, creates a partnership, joint venture or relationship between you and us beyond the relationship created under these Terms and Conditions.
8.4 These Terms and Conditions constitute the entire agreement between you and us regarding Formby Festival. These Terms and Conditions supersede any previous terms and conditions, agreement or arrangement between you and us. Each of the parties (you and us) agree that it has not entered into these Terms and Conditions in reliance on, and shall have no remedy in respect of, any statement, representation, covenant, warranty, undertaking or indemnity (whether negligently or innocently made) by any person (whether party to these Terms of Conditions or not) other than as expressly set out in these Terms and Conditions. Nothing in this clause shall operate to limit or exclude any liability for fraud.
8.5 These Terms and Conditions are subject to change from time to time at our sole discretion and we will notify you by posting the amended Terms and Conditions on our website.
8.6 These Terms and Conditions are subject to English law and all parties agree to submit to the exclusive jurisdiction of the English courts.
8.7 These Terms and Conditions do not and shall not affect your statutory rights as a consumer.
